This Privacy Policy applies to the websites, platform, mobile app, and services operated by Breeze Business Solutions LLC ("Breeze," "we," "us," or "our"). It describes how we collect, use, and disclose your information when you respond to our advertising, visit our website, contact us, use our products and services (the "Services"), or use the Breeze mobile app (the "App"). It also explains your privacy rights and how the law protects you.
By using the Services or the App, you agree to the collection and use of information in accordance with this Privacy Policy.
This Policy includes specific disclosures required by the laws of California, Colorado, Connecticut, Oregon, Texas, Utah, Virginia, and other states with comprehensive consumer privacy laws.

2. Who This Policy Covers
Different sections apply to different people.
- A visitor or prospect browsing our site, filling out a form, or talking to us about becoming a client: Sections 3 through 22
- A Breeze client, or an owner or staff member of a client business: All sections, especially Section 12
- A consumer who called, texted, or submitted a form to a local business that uses Breeze: Section 12. We process your information on that business's behalf, not our own. Direct your requests to that business
3. Mobile Communication Policy
3.1 Messages We Send You
We value your privacy and are committed to protecting your personal information. When you provide your mobile number, you consent to receive SMS messages related to our services, including notifications, account communications, authentication codes, and, if you opt in, marketing offers.
Your mobile opt-in and phone number will not be shared with third parties or affiliates for marketing purposes. Text messaging originator opt-in data and consent are not shared with any third party for marketing purposes under any circumstance.

- Cost: Standard message and data rates apply per your carrier's terms
Phone numbers may be processed by service providers, including our platform provider GoHighLevel and its LC Phone System telephony service, solely to deliver the messages you have consented to receive. Those providers may not use the information for their own marketing.
3.2 Messages Sent Through the Platform by Our Clients
Our business clients use the Platform to call and text their own leads from a business phone number we provision for them. Those messages are sent by the business, not by Breeze. The business is responsible for obtaining the consent it needs to contact its leads.
Every conversation honors opt-out keywords automatically. A lead who replies STOP, or a similar keyword such as UNSUBSCRIBE or CANCEL, is unsubscribed from that business's number and receives no further texts from it unless they opt back in by replying START or UNSTOP.
Message frequency depends on the lead's conversation with the business. Standard message and data rates apply. Messages are delivered by our telephony provider, LC Phone System, solely to transmit them.
4. Information We Collect
- Identifiers: First and last name, email address, phone number, postal address, IP address, account username, business name
- Commercial information: Services purchased, subscription tier, add-on services, billing history
- Financial information: Payment card information (processed by Stripe), billing address
- Internet activity: Pages visited, links clicked, time on site, referring URL, device and browser data
- Geolocation (approximate): City and state derived from IP address. We do not collect precise geolocation
- Audio recordings: Sales, onboarding, and support calls (see Section 10); calls placed through the Platform when recording is enabled for a client's account; voicemails left for a client
- Professional information: Job title, trade or industry, business size, service area
- Business content: Your logo, photos, service descriptions, pricing, hours, and other materials you provide for your website and automations
- Inferences: Profiles built from the above to evaluate fit for our Services
- Sensitive personal information: Account login credentials, payment card information
- Platform content (processed for the client): The names and phone numbers of the client's leads; text messages and images exchanged through the client's number; form submissions; AI chat transcripts; call records including time, duration, and outcome; voicemails; call recordings where enabled
- Platform usage metering: Text segments, call minutes, and phone numbers used by the client, billed to their Breeze account
We do not knowingly collect: precise geolocation, racial or ethnic origin, religious beliefs, sexual orientation, immigration status, genetic data, biometric data, health information, or information about children under 16.
5. Where We Get Your Information
- Directly from you: when you fill out a form, book a call, sign up, contact us, or sign in to the Platform or App
- From your device: through cookies, pixels, and similar technologies on our website; through the push notification token your device issues when you allow notifications in the App
- From our clients: when a client adds you as an owner or staff member of its account, or when a client's leads contact it through the business phone number we provisioned
- From advertising partners: Google, Meta, and other platforms that deliver our advertising
- From service providers: including our platform provider, payment processor, telephony provider, and analytics providers
- From publicly available sources: business directories, public records, review platforms, and similar sources used for local SEO work
6. How We Use Your Information
- Provide and operate the Services: account creation, billing, customer support, account communications, building and hosting your website, running automations, delivering calls and text messages, sending notifications, metering usage for billing
- Perform marketing services for clients: local SEO work, Google Business Profile management, advertising campaign management, review request automation
- Sales and marketing: respond to inquiries, follow up on leads, send promotional email and SMS where consented, retarget visitors of our website
- AI features: generate responses through AI chat agents, draft messages and review responses (see Section 11)
- Analytics and improvement: understand how the Services are used, diagnose problems, develop new features
- Advertising: measure ad performance, build audiences, retarget website visitors. This is "sharing" under California law. See Section 8
- Quality assurance and training: review recordings of our own sales, onboarding, and support calls to train our team and improve service
- Security and fraud prevention: detect, investigate, and prevent fraudulent or unauthorized activity
- Legal compliance: comply with applicable laws, court orders, and regulatory requirements, including telecommunications messaging rules
- Business operations: accounting, recordkeeping, audits, corporate transactions
We do not use client Platform content for marketing, and we do not use it to train our own models.
We will not use your sensitive personal information for purposes other than those permitted by California law without first offering you a right to limit such use.
7. How We Share Your Information
- Platform and hosting provider (GoHighLevel): To operate the white-labeled platform, CRM, mobile app, and website hosting on our behalf under written contract
- Telephony and messaging provider (LC Phone System, our platform's built-in telephony service): To provision phone numbers and deliver calls, SMS, and MMS
- Payment processor (Stripe): To process payments and manage subscriptions. Full card numbers are held by Stripe, not by us
- AI model providers: To generate AI chat agent responses and drafted content. Providers are contractually prohibited from training on this content
- Analytics and advertising partners (Google, Meta, and similar): To deliver and measure advertising for our website. This is "sharing" under California law. Client Platform content is never shared with advertising partners
- Email delivery providers: To send transactional and marketing email
- Professional advisors (attorneys, accountants, auditors): For legal, accounting, and compliance purposes
- Acquirers: In connection with a merger, acquisition, financing, or sale of assets
- Government authorities: When required by law, subpoena, or court order
We require service providers to use personal information only for the purposes we authorize, under contractual obligations of confidentiality and security.
Between a client and its leads. When you contact one of our business clients, your messages, calls, and contact details are visible to the owner and staff of that business in the Platform, and to Breeze staff assigned to that account. We process this information as a service provider to the business.

8. Sale and Sharing of Personal Information
We do not sell personal information for money.
We do share the following categories of personal information collected on our website with advertising partners for cross-context behavioral advertising, which is treated as a "sale" or "sharing" under California, Colorado, Connecticut, and other state laws:
- Identifiers, including online identifiers and IP address
- Internet activity, including pages visited and ads clicked
- Inferences
You have the right to opt out at any time:

We do not sell or share any client Platform content, including leads, conversations, call records, or recordings. We do not knowingly sell or share the personal information of consumers under 16 years of age.
9. Cookies, Pixels, and Tracking Technologies
We use cookies, pixels, and similar technologies on our website to:
- Keep you logged in and remember your preferences (essential)
- Measure traffic and performance (analytics)
- Deliver and measure advertising
Managing cookies:
- Browser settings: most browsers let you block or delete cookies. Blocking some cookies may affect how the site works
- Industry opt-outs: optout.aboutads.info and optout.networkadvertising.org

We do not use session replay technology on our website.
Browser signals. Our website does not currently respond to Do Not Track or Global Privacy Control browser signals. To opt out of sharing for advertising, use the email method described in Section 8.
10. Call Recording
10.1 Calls With Breeze
We record sales, onboarding, and support calls for quality assurance, training, recordkeeping, and dispute resolution. At the start of each call we provide a verbal notice that the call is being recorded. By continuing the call after this notice, you consent to being recorded. If you do not wish to be recorded, tell us at the start of the call and we will pause the recording or end the call.
Recordings are stored securely, accessible only to authorized personnel and our service providers, and retained as described in Section 13.
10.2 Calls Placed or Received Through the Platform
Call recording is off by default on client accounts. Calls between a client and its leads are recorded only when call recording has been turned on at the request of the client's owner. A client may turn it on or off at any time by contacting [email protected].
When recording is on, the client, not Breeze, is responsible for giving any notice and obtaining any consent required by the laws that apply to it and to the person it is calling. Several states, including California, Florida, Pennsylvania, Washington, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Connecticut, Delaware, and Oregon, require the consent of every party to a recorded call. Clients calling or receiving calls from residents of those states are responsible for providing a recording notice and obtaining consent.
Recordings and voicemails are stored with our platform provider, encrypted at rest, and available only to the client's owner and staff and to Breeze staff assigned to the account.
11. Artificial Intelligence
Some Services use AI systems, including AI chat agents that respond to inquiries on our clients' websites and automated drafting of messages and review responses.
When you interact with an AI chat agent:
- The content of your conversation is processed by a third-party AI model provider to generate a response
- The conversation is stored in the client's contact record
- Conversations may be reviewed by humans for quality assurance and troubleshooting
AI-generated responses may contain errors. Do not rely on an AI agent for pricing, availability, or service commitments without confirming directly with the business.
We do not permit our AI model providers to use conversation content to train their models. We do not use client conversation content to train our own models.
12. Our Role Regarding Client Data
When our clients use the Platform to collect and process information about their own customers and prospects, the client is the controller or business under applicable privacy laws and Breeze is the processor or service provider.
In that role:
- We process personal information only to provide the Services, as directed by the client, or as required by law
- We do not sell or share that information, and we do not use it for our own purposes or for advertising
- We require our subprocessors to meet obligations no less protective than our own
- We notify the client without undue delay of any security incident affecting their data
- We delete or return the information as described in Section 13
Clients are responsible for providing required privacy notices to their own customers, obtaining required consents, honoring opt-outs, and responding to privacy rights requests from their customers.
If you are a lead or customer of a business that uses Breeze and your request concerns the messages, calls, or form submissions you exchanged with that business, contact that business directly. If you cannot reach them, email [email protected] and we will forward your request to them.
13. Data Retention
We retain personal information for as long as necessary to provide the Services, fulfill the purposes described in this Policy, comply with our legal and accounting obligations, resolve disputes, and enforce our agreements.
- Client account records: While the account is active, and for 30 days after termination, after which the data may be deleted or archived
- Client Platform content (leads, conversations, call records): For the duration of the client's Subscription, then 30 days after termination to allow export
- Marketing leads and prospect records: Until you request deletion or opt out, or until we determine the information is no longer needed
- Billing and tax records: At least 7 years, as required by law
- Call recordings (Breeze sales, onboarding, support): Indefinitely, for training, quality assurance, and dispute resolution, unless deletion is requested
- Call recordings (client to lead, where enabled): For the duration of the client's Subscription, then handled under the client's agreement with Breeze
- SMS consent and opt-out records: Retained for as long as required to demonstrate compliance, including after opt-out, so that we can continue to honor the opt-out
- Website analytics (identifiable): Up to 26 months
- Cookies: Session-only or up to 13 months, depending on type
- Support tickets: While the account is active and for a reasonable period thereafter
- Platform usage metering (segments, minutes): With billing records, at least 7 years
You may request deletion at any time as described in Section 15. After deletion is processed, we may retain limited information necessary to comply with legal obligations, resolve disputes, prevent fraud, and enforce our agreements.
14. Your Privacy Rights
Depending on the state where you reside, you have some or all of the following rights:
- Right to know / access: Get a copy of the personal information we have about you
- Right to delete: Request deletion of your personal information
- Right to correct: Fix inaccurate personal information
- Right to portability: Receive your information in a portable format
- Right to opt out of sale/sharing: Stop us from sharing your information for cross-context behavioral advertising
- Right to limit use of sensitive PI: Restrict use of sensitive personal information to limited purposes
- Right to non-discrimination: We will not deny services, charge different prices, or provide a different quality of service because you exercised your rights
- Right to appeal: If we deny your request, you may appeal (Virginia, Colorado, Connecticut, Texas, Oregon)
If you are a lead or customer of one of our business clients and your request concerns the messages or calls you exchanged with that business, we will forward your request to the business or direct you to it, because that business controls the information.
15. How to Exercise Your Rights

We will:
- Acknowledge your request within 10 business days
- Respond within 45 days. If we need more time, we will notify you and may extend by an additional 45 days
- Provide the first request in any 12-month period at no charge
Verification. To protect your information, we will ask you to confirm details we already have on file, such as your email address and your most recent interaction with us. We may ask for additional verification if the request involves sensitive information.
Authorized agents. You may designate an authorized agent to make a request on your behalf. We require written, signed authorization and will verify the identity of the consumer.
Appeals. If we deny your request and you reside in Virginia, Colorado, Connecticut, Texas, or Oregon, you may appeal by emailing [email protected] with the subject line "Privacy Appeal." We will respond within 45 days (Virginia, Connecticut, Oregon) or 60 days (Colorado, Texas).
16. State-Specific Disclosures
16.1 California (CCPA / CPRA)
In the past 12 months, we have:
- Collected the categories of personal information listed in Section 4
- Disclosed personal information for a business purpose to service providers and professional advisors
- Shared personal information for cross-context behavioral advertising with advertising partners (see Section 8). Website data only. Client Platform content is never shared
- Not sold personal information for monetary consideration
- Not knowingly collected or sold the personal information of consumers under 16
California residents may designate an authorized agent. We do not offer financial incentives in exchange for personal information.
You may also request information about disclosures we have made for direct marketing purposes under California's "Shine the Light" law by emailing [email protected].
16.2 Colorado (CPA), Connecticut (CTDPA), and Oregon (OCPA)
Residents of Colorado, Connecticut, and Oregon have the rights described in Section 14, including the right to opt out of targeted advertising, sale, and certain profiling. To exercise these rights, contact us as described in Section 15.
16.3 Virginia (VCDPA)
Virginia residents have the rights described in Section 14. We do not engage in profiling that produces legal or similarly significant effects.
16.4 Texas (TDPSA)
Texas residents have the rights described in Section 14. As required by Texas law: We do NOT sell sensitive personal data. We do NOT collect or sell biometric personal data.
16.5 Utah (UCPA)
Breeze is a Utah business. Utah residents have the rights granted under the Utah Consumer Privacy Act, including the right to access and delete personal data and to opt out of targeted advertising and the sale of personal data. Contact us as described in Section 15.
16.6 Other States
Residents of other states with comprehensive privacy laws, including Iowa, Montana, Tennessee, Indiana, Florida, Delaware, New Jersey, New Hampshire, Kentucky, Maryland, Minnesota, and Rhode Island, have the rights granted by the laws of their state. Contact us as described in Section 15 to exercise them.
17. Children's Privacy
Our website and Services are not directed to children under 16, and the Platform is a business tool intended for adults 18 and older. We do not knowingly collect personal information from children under 16. If you believe we have collected information from a child under 16, contact [email protected] and we will delete it.
18. Data Security
We use reasonable administrative, technical, and physical safeguards to protect personal information, including encryption in transit, encryption at rest with our hosting providers, access controls, and vendor due diligence.
No method of transmission over the internet or method of electronic storage is completely secure. While we use commercially acceptable means to protect your personal information, we cannot guarantee absolute security.
You are responsible for maintaining the confidentiality of your account credentials and for the security practices of anyone you grant account access.
If we become aware of a security incident affecting your information, we will notify you without undue delay and as required by applicable law.
19. International Users
The website, Services, and Platform are operated from the United States. If you access them from outside the United States, your information will be transferred to and processed in the United States, where privacy laws may differ from those in your location. By using them, you consent to that transfer.
20. Third-Party Links
Our website and the websites we build may contain links to third-party websites and services. This Policy does not apply to those third parties. We encourage you to read their privacy policies before providing information to them.
21. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The "Last Updated" date at the top reflects the most recent change. If we make material changes, we will notify you by posting a notice on our website or by email. We review this Privacy Policy at least once every 12 months.
